I'm okay with it. He basically says that modern armies will rape women when they take their territory, and that this Quran verse is no different. Essentially his argument is that divine permission to rape women is no worse than the unsanctioned actions of individuals whom are punished when found guilty.

Indeed. It's a standard position among religionists, and it's pretty much intrinsic to Sunni Islam.

No, I think his excuse is "It is bad but every body does it, so Allah made people have to pay for it with food and clothing" - that's what I get from it anyway.

They are hoist by their own petard.

Either Islam is eternal and immutable in its perfect morality, or it was a localised, contextual religious code that is limited and stunted by the time in which it was prescribed.

In which case, it is backwards and worthless for the modern world.

The only way to get out of that ditch is to by-pass the literalism of it all. In which case Islam can be mataphorical-ised. However, it then loses its immutable and universal truth claims, and gets cut down to the same size as, well, every other religion or superstition that has been liberalised and de-literalised. In other words, Islam castrates itself, if Muslims go down that route.

Hence the neurosis, anxiety and hair-pulling in modern day Islam.

Its Catch 22, it really is.

Sure a Shia thing, however Sunnis also acknowledge that at some time it WAS allowed..! The defense of Shia for allowing temporary marriage (muta') is also pathetic:
