Female Sudanese journalist Lubna Husein faces 40 lashes for wearing pants in public

    Quote
A Sudanese woman facing 40 lashes for wearing trousers in public made her first appearance today in a court packed with supporters, in what her lawyer described as a test case in Sudan's decency laws.

There were chaotic scenes as Lubna Hussein, a former journalist who works for the United Nations, attended the hearing wearing the same green slacks that got her arrested for immodest dress. Indecency cases are not uncommon in Sudan. But Ms. Hussein has attracted attention by publicizing her case, inviting journalists to hearings and using it to campaign against dress codes sporadically imposed in the capital.

The case was adjourned as lawyers discussed whether her status as a UN employee gave her legal immunity.

After the hearing, defence lawyer Nabil Adib Abdalla said Ms. Hussein had agreed to resign from the United Nations in time for the next session on Aug. 4 to make sure the case continued. ?First of all she wants to show she is totally innocent, and using her immunity will not prove that,? Mr. Abdalla told reporters. ?Second she wants to fight the law. The law is too wide. It needs to be reformed ... This is turning into a test case. Human rights groups will be watching this closely.?

He said Ms. Hussein was ready to face the maximum penalty for the criminal offence of wearing indecent dress in public, which was 40 lashes and an unlimited fine. Before the hearing Ms. Hussein said she was arrested in early July when police raided a party she was attending at a restaurant in Khartoum's Riyadh district.

?Thousands of women are punished with lashes in Sudan but they stay silent,? she said. ?The law is being used to harass women and I want to expose this.?

She said a number of other women arrested with her received lashes. But her case was sent for trial when she called in a lawyer.

And this is the same government who is backing raids on villages in Darfur and capturing the natives to be sold as slaves to rich Arabs in Khartoum.  To me it seems that the Sudanese government is trying to be more Arab than the Arabs with this kind of behaviour or perhaps they are concerned that they may lose legitimacy, hence the crackdown on women's dress which is almost always the first tactic of a dictatorial, faith based government when a perceived threat looms on the horizon.

The Arabs have been fortunate enough to have oil and fund their education, and enforce their societal structure.  Othewise I have no doubt they too would be in the same mess.

Thats what happens when the Quran and Sharia Law are put into governing power in these counties after having spread by violence in the first place and nothing is done to oppose it.

We keep hearing about how Jack Straw or the French government have mentioned the veil and our doing so puts us in the same boat as them. How so? I want a ban on the burka, neqab and child veiling.

Al-Hussein -- who writes for a newspaper and worked for the media department of the United Nations mission in Sudan -- resigned from her U.N. position to deliberately lose immunity and face the charges.

She was "disappointed" with the court's decision to delay her trial, Adib said. "She wanted to have her case tried in order to clear her name and have the law announced unconstitutional," he said.

Al-Hussein told the British Broadcasting Corporation that she wants a public flogging to make a point about the treatment of women in Sudan. She even sent out 500 invitations to witness her lashings.

"I'm not afraid from pain ... but flog is not pain, flog is (an) insult, insult to humans, insult to women," al-Hussein told the BBC.

    OUCH!

I think we should administer 40 lashes to anyone who wears the Burka, on the naked bum with a wire.

    Thins brings up a debate.

Muslims come into the west crying about their freedom to wear their Burkha / Niqab / Hajib, yet in Muslim countries they dont even have the freedom to wear trousers?

Beyond pathetic crying and whinging little scums they are.

Why the heck should we allow them to dress up in a mobile tent, when they dont even allow western clothes in their countries?

I was a Muslim once, and I am seeing his point.

He has a point. He is criticizing the Muslim double standards here. I am from a country where Alcohol is totally banned and you get locked up for drinking beer in public or at home. Yet they protest other countries if they suggest banning burqas!

If that is not double standard ill-minded bigoted idiotic behavior, I don't know what it is!

You're getting a bit out of order with some of your comments ExHindu, eg the one I've quoted above.  You need to cool it and stop throwing generalised insults at all muslims for the actions of a few.

And because of the actions of the few, we have Sharia courts. And discrimination against religion is now considered racism and punishable by Law.

Yet in their Sharia counties, they dont treat non muslims with any more respect then they demand from the west.

This. I dont think Muslims are any worse then Christians, Hindus, the BNP, or any other faith.

Reigion should not be allowed political power anywhere in the world.

If by 'we' you mean the UK, what you have is a legal system in which anybody can choose their own form of arbitration in a civil dispute, including Sharia Law.  The Jewish people in Britain have been doing that for years with their own religious courts.  Not that big a deal.

I don't particularly want my country to lower itself to the standards of Saudi Arabia, I would prefer we carry on respecting the rights of minorities.

I'd agree with amending the Arbitration Act, but I don't think its a big deal if it isn't amended.  Religious courts have been operating in the UK for hundreds of years and it hasn't fallen apart yet.

    Never mind:

Jewish courts are in daily use in Britain, and have been for centuries.

I didnt know, I dont want those either.

But it is still true that people in Islamic countries cannot be trialed under foreign laws, so why do we have to allow it in the UK?

I agree with ex-Hindu, the Jewish courts operated at a different level to the Muslim courts and Judaic talmud laws work in a very different level, plus Muslim power and influence far outstrips any Jewish influence at any time period

Having said that one law for all is the best idea. I don't believe in giving everyone the choice, heck as a legal student the thought of Ombudsmen scares the bjeezus out of me! But that's a story for another day, as long as UK law is officially secular, it should apply to all

By the way ex-Hindu I think you should tone down your language a bit, I know your passionate and I can understand why, but it won't work out for you and your opinions will be ignored if you talk in such an aggressive manner-trust me on that. Just some friendly advice!

The UK does not allow people to be tried under foreign laws.  If two people are involved in a civil dispute they have the  right to go into arbitration to settle it, and they have the right to choose which principles that arbitration is carried out under.
