Wow...I mean, just...wow. I don't care what your opinion is on gun control, this is just straight-up fucked-up. I mean, what the hell was the court thinking?

Judge Christopher Critchlow said: "This is an unusual case, but in law there is no dispute that Mr Clarke has no defence to this charge.

Then change the goddamn law you fucker! finmad

Glad to see the papers got a hold of it - let's hope for once the tabloids do what they do for a good cause and totally humiliate the people - and the law - that would imprison a man for doing the right thing.

Hope they then let him go home with a massive apology!

Judges dont change laws, thats what ministers do.  They are there primarily to sentence or decide which laws have been contravened.

Why is it fucked up - its merely procedural.  He has not been sentenced yet?

I didn't mean the judge should change it, just anyone who can needs to get involved. This is a stupid law.

What the article dosen't state is that the mandatory five year sentence is rarely handed down. Most of those convicted of being in possession of a firearm get 18 months to two years. Its a bit like the three strikes and you get life saga - "You will be sentenced to life imprisonment and will serve a minimum sentence of four years".I should imagine in this soldiers case he will get a conditional discharge or token fine.

Even if he walks away with a fine of 10 lbs, he got a weapons possession conviction that will be on his record (yeah that's a really great thing to be walking around with next time he gets stopped by the cops or applies for a job), was arrested and confined, forced to go through court proceedings-- all for doing the right thing. He did absolutely nothing wrong. This is completely unjust and total bullshit, and the British injustice system should be fuckin ashamed of itself for its perfunctory application of the law, as should the dumbfuck legislators who wrote the law. In fact, whoever wrote the law should go away to prison for 5 years.

See my response to IsLame above. You want to act like it's no big deal, but this guy should not have lost his liberty for even a second (which he did when he was arrested), should not have been forced to waste time and money on going to court, and should not have to have this bullshit conviction on his record. He did nothing wrong! Why the hell anybody here is even suggesting this is anything less than a horrible injustice is beyond me.

What if you or IsLame found a gun in your backyard, gave it to police, got arrested, convicted and faced a 5-year sentence, whether you thought 5 years was likely or not? Would you still be acting like it wasn't a big deal if it was YOU?

    fuck you

Wow, so if I find a gun on the street, I should report it and risk someone with bad intentions getting hold of it, and possibly killing me(if I was still standing there) or any innocent person passing by at that time.
    Talk about stupid laws

You guys have no charter of rights in the UK? It works wonders against stupid laws like setting up an absolute liability with an attached jail term. I mean wtf!

I was commenting on what kind of sentence he could expect.Of course it is absurb in even bringing the case to court and it should have been thrown out by the CPS.I would put a lot of this down to targets,ie,police have solved another gun "crime" and can chalk up another brownie point to keep the Home Office happy.

That is the dumbest thing I have heard for weeks, even taking US conservatives into account. What if he calls the cops and they "find a firearm on his premises"? Is he still fucked or what?

That is ridiculous. What's even more mad is that I live right by where this happened and never saw any mention of it in the papers, yet Q-Dawg, all the way from the US, did Smiley I would have hung on to it I think Wink

He should have been thanked, not jailed, but this is a police state and we are all criminals.

Although I agree with everyone here that his arrest was completely out of order, if it was me, I would've called the station prior to taking the gun there just so they have a heads up. Because when you walk into a police station with a firearm, I could understand where the reaction to arrest him might come from. I don't agree with his arrest, but I do feel it was a slight case of misjudgment from the ex-soldier's end, that may have prevented this. But then again, small things like this we typically are not cautious about. Lesson learned I guess.

good point... He is in deep sh*t either ways. Just as well he should have used it and raided the bank near him. If arrested he will propably get 5 years just the same.
