    Shamso Miah, 25, of Redbridge, east London, broke a man's jaw following a row in a bank queue.

    Sitting as a judge, Ms Booth - wife of former Prime Minister Tony Blair - said she would suspend his sentence on the basis of his religious belief.

    The National Secular Society claims her attitude was discriminatory and unjust.

    'Acceptable behaviour'

    Inner London Crown Court heard that Miah, 25, of Redbridge, east London, went into a bank in East Ham and became embroiled in a dispute with Mohammed Furcan about who was next in the queue.

    Miah - who had just been to a mosque - punched Mr Furcan inside the bank, and again outside the building.

    Ms Booth told Miah that violence had to be taken seriously, but said she would suspend his prison sentence because he was a religious person and had not been in trouble before.

    She added: "You are a religious man and you know this is not acceptable behaviour."

    The National Secular Society has complained to the Office for Judicial Complaints, suggesting that Mrs Blair acted in an unjust and discriminatory way, and suggesting that she might have treated a non-religious person less leniently.

    What a numpty!  Doesn't she realize that letting a guy like this go purely because he's 'religious' will only serve to send out the message to the rest of the bearded nutters in this country that they can get away with this type of bullying behavior because they are 'religous'.

    I don't really think she suspended the sentence because he is religious. That sort of crime would not usually end up with a jail term anyway. He had not been in trouble before and I think she used an unfortunate choice of words when she said "you are a religious man and you know this is not acceptable behaviour".

    It doesn't take a religious person to see that is not acceptable behaviour.

    Wrong. Just wrong. We should all be equal infront of the law. Not the "Equal but different bullshit". Osama Bin Laden is a very religious man, doubt many would consider him to be a good person. And that doesn't matter, our personal opinions of a certain person. The law is the law. You judge a person on their actions.

    Maybe you're right - but her choice of words is really stupid, the suppositions behind them are silly, and it is slightly offensive too.

    Whether or not he would have gotten the sentence anyway is completely irrelevant

    As soon as she uttered those words she put her credibility and decision into question-regardless of what she meant. Very poor decision and there should be a full investigation.

    Man, if I was the guy whos jaw was broken I would be filing a lawsuit against Cherie Blair for her utter stupidity!  C'mon, guys!  Think about it.  You're in a bank, some basterd fresh from the mosque comes in and punches you in the face and then punches you again as you leave the bank all over who was first in the damned queue, wouldn't you be pissed off at this seeming lack of justice?!

    i think she was just trying make this man see the err of his ways by appealing to his religious side - could have put it in a better way- but she is well known for her big gob.  However I doubt he was let off because he was a muslim as insiniated here - no big deal

     We don't really know what happened.Was he attacked or did he provoke the incident? If he attacked first he is clearly not a religous man.What is surprising is that he struck the man twice,both inside the bank and also outside so it was two seperate incidents.Breaking someone's jaw is a serious offence and usually carries a custodial penalty unless it can be proven you acted in self defence.

    I don't know. But I know this breaking a man's jaw means you were out to hurt them. You don't lightly punch somebody and break their jaw. i dobut the struck him twice, wouldn't surprise me if he punched him several times.

    Let's reverse it and change that she said he was religious. If he had been a black guy robbing a bank and she had said: "I know you are black so violence comes naturally...." would her decision not be questioned? She has pointed out a single factor (religion) and it throws her decision into question.

    End of.

    It was an ill considered thing to say, but with things as important as court cases anything that could be seen as a wrongdoing should be investigated and potentially done again

    Rather than just excusing her action as "ill-considered words"-when potentially she employed prejudice when making a legal judgement

    A big no-no.

    No, using saying a judge chose ill-considered words is actually quite a big statement.  Its enough to give them the chop.  And rightly so I believe.  So I think you are arguing over nothing.

    She has put her foot in it in a big way. It was an utterly stupid thing for her to say and with that attitude she has no business sitting as a judge.

    It's not just illconsidered, it potentially an offence.  Thanks to her husband racial and religous now have parity both in terms of aggravating criminal offences and legislation regarding discriminination.  If an employer refused to promote someone citing their lack of faith they would commit an offence so surely a judge who bases a sentance on the convicts faith also commits an offence?

    In my opinion, these atheist organizations going nuts over this case are making a mockery of themselves. Here is what the judge said:

    You caused a mild fracture to the jaw of a member of the public standing in a queue at Lloyds Bank. You are a religious man and you know this is not acceptable behaviour."


    Suspension of the sentence for a first offender in such cases is probably standard procedure. I understand her mentioning his religion as a clever psychological trick to  send the offender on a special guilt trip.

    It's like saying

    It's a trick to make the offender feel bad. The religiosity of the offender was not really the reason for the suspension of the punishment.

    Actually, the victim was a muslim himself and in an interview he got quite upset and demanded his wrongdoer could not be a real muslim  Cheesy Cheesy
