Widow & Widower's Shares of Inheritance:

I know that Islam gave a daughter half the inheritance of a son, but this is something I had read, but not really pondered over, the widower's share of inheritance is also twice that of a widow!

Here are the Quranic verses:

004.012

YUSUFALI: In what your wives leave, your share is a half, if they leave no child; but if they leave a child, ye get a fourth; after payment of legacies and debts. In what ye leave, their share is a fourth, if ye leave no child; but if ye leave a child, they get an eighth; after payment of legacies and debts.

PICKTHAL: And unto you belongeth a half of that which your wives leave, if they have no child; but if they have a child then unto you the fourth of that which they leave, after any legacy they may have bequeathed, or debt (they may have contracted, hath been paid). And unto them belongeth the fourth of that which ye leave if ye have no child, but if ye have a child then the eighth of that which ye leave, after any legacy ye may have bequeathed, or debt (ye may have contracted, hath been paid).

SHAKIR: And you shall have half of what your wives leave if they have no child, but if they have a child, then you shall have a fourth of what they leave after (payment of) any bequest they may have bequeathed or a debt; and they shall have the fourth of what you leave if you have no child, but if you have a child then they shall have the eighth of what you leave after (payment of) a bequest you may have bequeathed or a debt.

If men have more than one widow, their shares are further diminished.

So if a Muhammad marries a wealthy old sugar mommy Khadija, he inherits twice what an Anna Nicole Smith would inherit from a Howard Marshall?

Yep, my step mum is feeling the pinch of this ruling, not that my dads dead yet but the inheritance has been counted up and laid out what to who because he is ill and over 60.

She is not happy, you know deep down she thnks it is unfair, but as a muslim woman she just has to bury her resentment.

I honestly don't care about inheriting anything from my dad, but of course it bugs me to know that my brothers are due alot more than me.

Yep, this is bad, since women have longer life expectancy than men, & are mostly younger than their husbands, they should have inherited at least as much as a widower would.

My maternal grandpa doesn't have any sons, he has two daughters-my mom & aunt & he says that Allah gave women half an inheritance because of the societies of those days, it was a progressive step, & it actually leads to full inheritance today, just like Islamic instructions on manumitting slaves leads to the ultimate abolition of slavery.

I disagree of course, but if every Muslim could interpret his\her text this way, then we'd have different laws!

I'd need to look it up, but I thought in the case of no sons, the girls still couldn't inherit it all?

So the Quran says, grandpa's somehow managed to explain it away!

He & the Bohra\Ismaili sect mom belongs to, also accept Muslim women marrying non Muslim men, as does Islam in Sierra Leone, Senegal, Mali & some African nations south of Sahara.
