  • Question about scholars
     OP - August 07, 2009, 12:53 AM

Can someone help me out with this - having watched a ton of lectures/videos on youtube & The Deen Show, I'm a bit confused...

    1.  Are scholars the only "people of knowledge" who can issue fatwa's?

    2.  I am guessing any Muslim can give lectures?  (Evidenced by people like Yusef Estes and Khalid Yasin).

    3.  Re: Zakir Naik, I read somewhere that he is not a scholar but a "comparative religion" speaker.  So basically he gives lectures but is not a scholar?

    4.  Is Sheikh an honorary title given to Muslims?  (IE Estes & Yasin).

    Thanks for any help.

    1. Anyone can issue the fatwa. The strength of the fatwa depends on the political, military or cultural clout of any clown who chose to make the fatwa. Very very rarely, some people will offer the 'isnad - support' of their fatwa and which text they made their fatwa from.

Experienced muftis, will avoid tooth-and-nail from giving the isnad behind their fatwa. Because it can be very easily contradicted within islam or often made worse.

Case in point, some woman tried to ask a mufti on egyptian tv if it is haram to giveher kid medicine with alcohol in it. The mufti told her it is ok to give the medicine and read her a supporting verse. She ended up reading him back another verse and then hadith that made it haram to give the kid the medicine. The sheikh was embarrassed as he could not reply to her logic. She out-fatwaed him but he chose to attack her person by showing how offended he was (clout) with her behavior.

    2. what u mean by lectures? call to prayers - has to be the most knowlegeable. Actual lectures - see point #1.

    3. The more he confuses people about what he does, the easier it is for him to sneak.

    4. any old men gets the title usually, christian or muslim. Some younger men, through study of a certain book, can acquire the title much earlier,

"Ask the slave girl; she will tell you the truth.' So the Apostle called Burayra to ask her. Ali got up and gave her a violent beating first, saying, 'Tell the Apostle the truth.'"

There are no real qualifications for a sheikh, but that he must be more knowledgable than the common folk. Some people have different standards, and some who are called sheikhs won't be recognized as such by others. A degree from Madinah U or some other prominent school like Al-Azhar helps in legitimizing the claim, and recognition by other scholars as one of them solidifies it. So a community can have a 'sheikh', but he may not be recognised as such among other 'sheikhs'. 'Sheikh' literally means 'old man'. Salafis do not recognize that there are any sheikhs in 'The West', only in the lands of Islam. Characters like Estes and Yasin would be called 'Da'ees', or 'Duaat', callers, missionizers, but many will call them as sheikhs.
