Yes it is cruel. However Death Penalty for 1st Degree Murderers is no where near as cruel punishment as trying to deliberately paralyze someone founding guilty of aggravated assault. Life in Prison would be better

You said your constitution protects you from cruel punishment.
I pointed out that it does not.
Your counter argument is basically "but death penalty is not AS CRUEL as crippling etcetera".
Then you should reformulate and say that your constitution protects you from punishments that go beyond the limit of what YOU find acceptable ^_^
But that makes your constitution not universally morally good, and I guess that goes against the very point you wanted to make :S
