It hasn't been established if he's a "diplomat" or not:

LAHORE: Deputy Prosecutor General of Punjab, Rana Bakhtiar said on Sunday that Raymond Davis had fired the bullets from the back thus it was not a case of ‘self defense’ as he had stated earlier.

Rana also said that Davis, charged with murder of two motorcyclists in Lahore, did not hold any special privileges as a diplomat.

Referring to Article 49-2 of the Vienna Convention, he said that diplomatic officials only hold privilege when they are on duty, but Davis was in Pakistan on a business visa.

This depends. "On duty" has a specific meaning. If he was part of a diplomatic entourage then he does have diplomatic immunity irregardless of where he was or what he was doing or what visa was used. diplomatic immunity continues 24/7 while "on assignment ( on duty)" but if he wasn't part of an eutorage then he doesn't have diplomatic immunity no matter if he was helping a diplomatic mission or whatever.

So once again I'm left with the classic Irish man's dilemma, do I eat the potato or do I let it ferment so I can drink it later?

None of this talks about what I was talking about. Why would a diplomat agent or not go around and kill ISI agents when if he had contacts with a diplomatic mission or even part of the CIA? He would have been "captured" and sent back like every spy has ever been especially for something as mundane as photos of army installations. Instead apparently he decided to shoot it out in the middle of Pakistan with two ISI agents and call for back up. It doesn't make much sense, and I would lean towards being a hold up. Maybe the CIA has decided it likes shooting people for no apparent reason and cause international incidences but given Pakistan's less than amazing ability to be cogent and coherent I wouldn't think so, but who knows maybe I am wrong.

Edit: It would seem that the more I read the less the "car jacking a US consulate diplomat story" seems plausible. He was most likely CIA and not a State Department official. His actions still seem strange though

So what did happen? Lay it out for me because like I said it doesn't make much sense the way anyone has laid it out so far. Stratfor seems to think it might have been a spy meeting gone bad, the newspapers in Pakistan can't make up their mind if he is CIA or Xe, while the state department is spinning their own bullshit. So what happened and why seems very unclear.

That isn't to say he is innocent. He killed two people and diplomat, contractor, or president of the US he will have to stand trial in Pakistan. He may be a James Bond assassin or a spy or even a diplomat who thought he was getting held up ( though I doubt it) in every case he fucked up by carrying a gun and using it and now he'll have to face the music.

I would bet he will be executed in Pakistan

So once again I'm left with the classic Irish man's dilemma, do I eat the potato or do I let it ferment so I can drink it later?

I lived in Canada and US. And I do know the difference between mentality of rest of western countries compared to American. Americans can be very arrogant and ignorant. Court frees CIA contractor accused of murder: Rana Sanaullah., that is the breaking news .. good news.. good news all over good news..
